Probate is not the boogy man that everyone tries to make it. It is merely the process of transferring assets from one generation to another. It can now be done for a reasonable cost in a reasonable time.
Many assets do not pass through probate, but pass directly via a governing instrument, such as a deed, payable on death account, or beneficiary designation. What is left over passes through probate. Often when the first spouse dies, there is no probate. Likewise we can often pass what is left to adult children by summary procedures at a modest cost.
